Is it legal to use AI to answer a business's incoming calls in India?

Short answer

Yes. No Indian law stops a business from having an AI voice agent answer calls to its own number. The customer is calling you, so TRAI's DND and telemarketing rules for promotional calls do not apply to that call. The DPDP Act 2023 still governs what the agent collects, so announce recording, collect only what the enquiry needs and keep the agent away from regulated advice.

Why inbound is the simplest case

TRAI's TCCCP Regulations 2018 regulate commercial communication sent to subscribers. When a customer dials your clinic, showroom or office, they started the conversation, so DND preferences, 140-series rules and calling windows do not come into play for that call. What the agent does with the caller's data, and what it says, is still regulated.

Rules that still apply

  • —DPDP Act 2023: give a short notice of recording and purpose at the start, collect only what the enquiry needs, and secure recordings and transcripts.
  • —Consumer Protection Act 2019: prices, availability and promises given by the agent bind the business as if a staff member had said them.
  • —Sector rules: no diagnosis or prescription for clinics under the Telemedicine Practice Guidelines 2020, no investment advice without SEBI registration, no insurance advice outside IRDAI licensing.
  • —Follow-up calls: a callback about the caller's own enquiry is a service call; unrelated promotion later needs the usual DND checks.

Do not leave callers stuck

An AI answering service must not trap people. Offer a clear way to leave a message for the team, capture urgent requests and flag them so someone calls back quickly, and give emergency numbers where relevant, for example in a hospital's script. Saying that the caller is speaking with an AI assistant is good practice, even though no Indian law yet requires it.

Industries where it matters most

Clinics, diagnostic labs, real estate developers and coaching institutes get many calls outside office hours. Answering them at night is legal and useful, but the agent's limits should be stricter there: book, inform and log, rather than advise.

How Outpero fits

Outpero's AI employee answers calls to your business number around the clock, handles the enquiry, qualifies it, books appointments and logs everything, with a recording, transcript and summary for each call. Requests that need a person are flagged in the summary and webhook so your team can call back.

Follow-up questions

Do I need to tell inbound callers that the call is recorded?

+

No specific statute forces a recording announcement, but the DPDP Act 2023 expects a clear notice of what personal data you collect and why, and a recording is personal data. A short line at the start, such as 'this call is recorded for quality', is the simplest way to meet that expectation and avoid disputes later.
