Do I have to tell customers they are talking to an AI?

Short answer

As of now, no Indian statute specifically requires a business to announce that a caller is an AI. Disclosing it is still the safer course: the Consumer Protection Act 2019 prohibits misleading conduct, the DPDP Act 2023 expects clear notice about how personal data is used, and Indian and foreign regulators are moving towards labelling AI output. A one-line disclosure costs little and protects trust.

What the law says today

TRAI's TCCCP Regulations 2018 govern who may call and when, not whether the voice is human. The DPDP Act 2023 requires a notice describing what personal data is collected and why, which is easier to give honestly when the caller is upfront about what it is. Neither law contains an explicit 'disclose AI' clause.

The direction of travel is clear, though. MeitY's advisories on AI and its moves on labelling synthetically generated content push towards disclosure, mainly aimed at platforms. The EU AI Act already requires people to be told when they are interacting with an AI system. An Indian rule could follow, so building disclosure in now avoids rewriting scripts later.

  • —The agent claims to be a named human employee when asked directly, which can be a misleading representation under the Consumer Protection Act 2019.
  • —A cloned voice of a real person is used without consent, risking personality-rights claims and, where it deceives, cheating by personation under Section 66D of the IT Act 2000.
  • —The call collects sensitive details while the customer believes a person is exercising judgment on their case.

A disclosure line that works

Short and early works best: 'Namaste, this is Priya, an AI assistant from Sunrise Realty, calling about your enquiry on 99acres.' Most callers care more about whether their question is answered quickly, in their language, than about who is asking.

How Outpero handles it

You write the agent's opening line, so disclosure is a script choice. Add an explicit instruction that the agent must never deny being an AI if a caller asks, on outbound and inbound calls alike.

Not legal advice

AI disclosure rules are evolving in India and abroad. Recheck with counsel before a large campaign, especially in lending, insurance and healthcare.

Follow-up questions

Does telling customers it is an AI reduce conversions?

+

There is no reliable Indian data either way, so test it on your own calls. In practice, people judge a call by whether it is relevant and answers their question. A disclosed AI that responds quickly in their language is usually accepted, while a hidden one that is later discovered damages trust far more than an honest opening line would.
