Can an AI voice agent call numbers registered on DND?
Not for promotional calls, unless the person has given consent that meets TRAI's requirements. Under the TCCCP Regulations 2018, numbers on the National Customer Preference Register (the DND list) block promotional calls fully or by category. Service and transactional calls to people who deal with you are treated differently. An AI agent is held to exactly the same rules as a human telecaller.
How DND works today
The DND list is the National Customer Preference Register (NCPR) kept under TRAI's TCCCP Regulations 2018. A subscriber registers by calling or texting 1909, or through their operator's app or the TRAI DND app. They can block all promotional communication, or only categories such as real estate, education, health, or banking and financial products, and can restrict by time band and day.
A properly run campaign never dials a blocked number for promotion in the first place, which is why DND screening is done on the list before the campaign starts rather than call by call.
What an AI agent may and may not do
| Call type | Number on DND | Typical position |
|---|---|---|
| Cold promotional pitch | Category blocked | Do not call |
| Promotional call with explicit consent | Category blocked | Allowed only if consent is verifiable and recorded as the rules require |
| Callback to a fresh enquiry | Any | Generally treated as responding to a request; keep proof of the enquiry |
| Service call to an existing customer | Any | Allowed for a genuine service purpose, without a sales pitch added |
Where businesses slip
- —Adding an upsell to a service call, which turns it promotional.
- —Treating a purchased list as consented because the seller said so.
- —Screening once and reusing the list for months while preferences change.
- —Assuming numbers used for business are exempt without confirming it with the operator.
How Outpero handles it
Outpero screens every bulk campaign list against DND before dialling and skips matching numbers. Instant callbacks to a new enquiry are a separate flow, because the person has just asked to be contacted. Consent records for anything else remain the business's to keep. Inbound calls, where the customer dials your number, are not affected by DND at all.
TRAI amended TCCCP 2018 in 2025 and continues to tighten enforcement. Check current consent and DND handling with your operator or counsel before a large promotional campaign.

Follow-up questions
How often should a calling list be checked against DND?
+
Preferences can change any day, so check a list close to each campaign rather than once a quarter. A practical rule is to screen at upload and again if a campaign runs for more than a few weeks. Outpero screens bulk campaign lists automatically before dialling, which removes the manual step and the risk of an outdated scrub.
